General Terms of Use (GTC)

1. Scope and Provider
These terms of use govern the contractual relationship between the operator of Mallorca-Zero, Christian Donnert (hereinafter "Provider"), and the users (hereinafter "User") of the online platform. By registering or using the services, the User agrees to these terms.
2. Description of Services
Mallorca-Zero is a regional online marketplace that focuses exclusively on offers and requests related to the island of Mallorca. The Provider merely provides the technical platform on which Users can create and publish listings. Contracts initiated through these listings are concluded exclusively between the respective Users. The Provider will not be a contracting party to transactions concluded between Users.
3. Registration and User Account
- Use of certain functions (e.g., placing listings) requires registration. There is no legal entitlement to the conclusion of a user agreement.
- The User is obliged to provide truthful information and to keep their data up to date.
- Each User may create only one user account. The registration of multiple accounts is prohibited.
- Access data must be kept confidential and must not be passed on to third parties.
4. Principles for Placing Listings and Use of AI
- Regional relevance: Only listings that have a direct connection to Mallorca are permitted. Offers for real estate, jobs or services outside Mallorca are not allowed.
- AI optimization: The Provider is entitled to automatically translate listing content (e.g., via DeepL/OpenAI) and to optimize it for search engines (SEO). The advertiser remains responsible for the factual accuracy of the content.
- Copyrights: The User warrants that they hold all rights to the published texts and images. The use of third-party photos (e.g., copied from the internet or stock photos) is prohibited.
5. Prohibited Content and Activities
It is forbidden to publish listings that violate legal provisions, the rights of third parties or public decency. In particular, the following content and actions are not permitted:
- Broker solicitation: Real estate requests from real estate agents or commercial intermediaries (e.g., "Looking for properties for my clients"). Requests in the real estate category are reserved exclusively for private end users.
- No Mallorca relevance: Listings without a direct regional connection to the island of Mallorca.
- Multiple listings: Posting identical or equivalent listings (duplicates), including using different categories or email addresses.
- Third-party listings: Placing listings on behalf of third parties (representative listings).
- Unfair advertising: Pure advertising for external websites, in particular e-commerce shops, auction portals or company directories.
- Multi-level marketing: Offers for home-based work, network marketing (MLM), pyramid schemes or dubious investments/loans.
- Erotic & youth protection: Erotic offers and requests of any kind as well as pornographic or youth-endangering content.
- Gambling: Sweepstakes, betting offers of any kind including lotteries and other games of chance.
- Poor quality: Insufficiently described offers or listings that contain only a link to an external website without describing the product/service itself.
- Abusive communication: Insults, discrimination, racist statements as well as public warnings, appeals or evaluations directed at other users or companies within the listing text.
6. Usage Rights and Indemnification
- By posting content, the User grants the Provider the right to make this content publicly accessible and to distribute it on the platform and in associated channels (e.g., social media).
- The User indemnifies the Provider against all claims made by third parties arising from the infringement of their rights by content posted by the User. This also includes the costs of necessary legal defense.
7. Changes to Listing Content and History
- The advertiser is entitled to change, supplement or delete the content of their listing at any time, provided the listing is still active.
- A change to the listing text after an agreement has already been reached between buyer and seller does not affect the validity of the contract already concluded. The operator does not intervene in disputes regarding subsequent text changes.
- The operator reserves the right to store versions of the listing internally (history) in order to be able to provide information in the event of justified suspicion of legal violations or upon official request. The User has no claim to the disclosure of this history.
8. Fees and Paid Services
- The basic use of Mallorca-Zero is free of charge.
- The User has the option to purchase paid additional services (e.g., highlighted listings) via the integrated shop.
- Conclusion of contract: A paid contract is only concluded when the User clicks the button “Order with obligation to pay” (or a similarly clear label) in the shop.
- Billing is processed via the offered payment service providers (e.g., Stripe, PayPal). The User will receive an invoice by e-mail or as a download.
9. Right of Withdrawal for Digital Services
- Consumers generally have a statutory right of withdrawal of fourteen days from the conclusion of the contract.
- Premature expiration: The right of withdrawal expires prematurely for contracts for digital services (e.g., the immediate activation of a listing highlight) if the Provider has fully performed the service and the performance of the service began only after the User expressly consented to this and simultaneously confirmed their awareness that they would lose their right of withdrawal upon the Provider's full performance of the contract.
10. Measures in Case of Violations and House Rules
- The Provider reserves the digital house right. In the event of violations of these GTC (in particular point 5) or in case of justified suspicion of abuse (in particular in the case of disguised broker inquiries or spam), the Provider is entitled to delete listings without prior notice and to temporarily or permanently block user accounts.
- There is no legal entitlement to the use of Mallorca-Zero.
11. Limitation of Liability
- The Provider gives no warranty for the accuracy, completeness or currency of content provided by Users.
- The Provider is not liable for the continuous availability of the website or for technical malfunctions beyond its control.
- For damages, the Provider is liable only in cases of intent or gross negligence.
12. Final Provisions
The law of the Federal Republic of Germany applies. Should individual provisions of these terms of use be or become invalid, the validity of the remaining provisions shall remain unaffected. The Provider reserves the right to change these terms at any time. Changes will be notified to the User before they take effect.
